Occupational Safety, Health & Working Conditions Code

The Occupational Safety, Health and Working Conditions Code will consolidate and amend the laws regulating the occupational safety, health and working conditions of persons employed in an establishment in India.

SR. NO. COMPLIANCE DUE DATE
1. Registration of establishment which comes into existence after the commencement of OSHW Code (New establishment) Form I within 6 (six) months from the date on which OSHW Code comes into force
2. Establishment already registered under any other central labour law for the time being in force shall update the registration particulars on the Shram Suvidha Portal (Existing establishment) Form I within 6 months from the date on which OSHW Code comes into force
3. Updation relating to any change in the ownership, management or any particular furnished in registration form submitted on the Shram Suvidha portal Within 30 (thirty) days of such change
4. Employer of an establishment shall (a) inform the closing of such establishment and (b) certify payment of all dues to the workers employed in such establishment Within 30 (thirty) days of the closing of the establishment
5. Notice of commencement and completion of any work Form IV within 30 (thirty) days of such commencement and completion
6. Annual Return Form IX to reach Inspector-cum-facilitator not later than 1stFebruary following the end of each calendar year.1
7. Where at any place in an establishment which is factory, dock work, mines, building or other construction work, an accident occurs which results in bodily injury by reason of which the person injured is prevented from working for a period of forty-eight hours or more immediately following the accident, the employer or occupier or manager of the establishment shall send a notice. Form VI within twelve hours after the completion of forty-eight hours.
8. Notice by the employer of the establishment where there is any dangerous occurrence, whether causing any bodily injury or disability or not. Form VI within twelve hours
9. Application for renewal of contractor’s license At least 30 days prior to expiry of license period but not before 90 days of expiry of license.
10. Intimation of work order by contractor Within fifteen days of the receipt of a contract work
11. Payment of wages of every person employed as contract labour in an establishment or by a contractor

Before the expiry of seventh day after the last day of the wage period.
